In these Terms of Service, "User" refers to any person or entity using xopay.co and/or availing any Service from Xopay regarding education payments.

Acceptance of Terms

Use of the xopay.co website, Application, or any educational payment Services of Xopay is subject to the acceptance of these Terms and Conditions, as well as related policies such as the Privacy Policy, cancellation and refund policy, and chargeback policy. Please read these Terms carefully before registering, accessing, or using our Services related to education payments. Usage of the Application is also subject to platform-specific terms such as those imposed by the Play Store or App Store.

Scope of Services

Xopay.co enables Users to make online payments for education-related purposes, including but not limited to school fees, tuition fees, coaching fees, exam fees, and other educational institution-related payments. Xopay and its payment partners act as facilitators for authorized payments; Xopay does not assume responsibility or liability for unauthorized transactions. The User must ensure all educational transactions are valid and comply with applicable laws and institutional requirements.

User Responsibilities

Users must:

• Furnish accurate and complete information regarding payees and payment purposes.
• Be solely responsible for the legitimacy of payments and any potential tax implications.
• Safeguard personal payment information, including login credentials and OTPs.
• Use the Services exclusively for lawful educational payment purposes.
• Ensure compliance with relevant laws and educational institution guidelines.

Eligibility

Users must be at least 18 years old or have legal authorization from the entity they represent. Users agree to provide genuine documents for identity and address verification as requested by Xopay for education payment transactions. Any failure to comply may result in suspension of access to xopay.co services.

Registration and Account Security

Registration requires valid identification and current contact details. The User is responsible for maintaining account security and confidentiality. The User must promptly notify Xopay of any unauthorized access, misuse, or changes to account details. Impersonation or false representation is strictly prohibited.

Data Collection and Communications

Users consent to the collection, use, and sharing of personal and transaction data as outlined in the Privacy Policy, including for compliance with applicable legal, regulatory, or institutional requirements. Users agree to receive communications (including SMS, email, WhatsApp, auto-dialed or pre-recorded calls) for registration, transactional, or promotional purposes.

Use of Services

Payments via xopay.co must be made only for legitimate education-related purposes. Users appoint Xopay as an agent to process and settle funds on their behalf for educational transactions. Funds will be processed according to applicable timelines specified by service providers and Xopay. Any transaction confirmed via valid login and authentication will serve as conclusive evidence of completion.

Limitations and Disputes

• Xopay is not responsible for confirming delivery of educational services or products beyond payment facilitation.
• Disputes between Users and educational institutions/payees (including fees, delivery of services, or quality) must be resolved directly; Xopay is not a party to such disputes and does not guarantee timing of payments.
• All payments must be made in Indian Rupees only.

Restrictions and Prohibited Actions

Users may not use xopay.co for non-education payments, illegal purposes, fraudulent activity, or actions violating applicable laws or the integrity of the platform. Actions such as hacking, impersonation, reverse engineering, automated account creation, or dissemination of harmful content are strictly forbidden.

Fees and Taxes

Users agree to pay the convenience fees (non-refundable) for each education payment transaction as specified before transaction completion. Taxes, duties, or surcharges related to payments are the responsibility of the User. In case of any changes in fees or taxes, Xopay reserves the right to modify or implement new charges.

Chargebacks and Fraudulent Transactions

Xopay will process chargeback requests only if the payee refunds the amount. Xopay is not liable for chargebacks unless it receives the requisite amount from relevant authorities or service providers. In fraudulent cases, Xopay may suspend settlements and accounts pending investigation.

Termination and Indemnity

Xopay reserves the right to suspend or terminate accounts in cases of breach, fraud, or non-compliance. Users indemnify Xopay against all losses, claims, or damages arising from misuse, disputes, or breach of these terms. Users may cancel their accounts at any time by written request.

Intellectual Property

All trademarks, application content, service marks, and logos associated with xopay.co are owned or licensed by Xopay and may not be used or reproduced without prior written consent.

Miscellaneous

The Terms may be amended at any time without prior notice—Users are responsible for checking updates. Interruptions, technical failures, or force-majeure events do not render Xopay liable for damages. Any disputes will be subject to the exclusive jurisdiction of the courts in Nagercoil, Tamilnadu.
