1. SCOPE

This internet resource and domain, www.xopay.co, on the World Wide Web, and the application titled "Xopay Education Payments" ("Application") is owned and hosted by Xopay, having its corporate office at No.398A, 2nd Floor, MS Rd, Kattayanvilai, Nagercoil, Tamil Nadu 629003, under the brand name "Xopay" (hereinafter referred to as "Xopay", which also includes Xopay's affiliates, successors, and assigns).

Xopay is committed to protecting the User's information and privacy. Xopay facilitates the Users to make online education-related payments through the Application, which includes but is not limited to school/college fee payments, tuition fees, examination fees, coaching fees, library/lab charges, hostel fees and other education service payments ("Services").

Users agree to take full responsibility for the Transactions made on the platform with respect to the nature of payment, beneficiary institution, and any tax implications pertaining to the same.

For the purposes of this Privacy Policy, a "Transaction" means a payment instruction that results in the successful transfer of money or settlement from a User to an educational institution, school, college, or other recognized educational service provider.

This Privacy Policy is designed to help the User understand how Xopay may collect, process, store and use the information provided by the User to Xopay, and to assist the User in making informed decisions while using the Application and the Services.

This Privacy Policy has been published inter alia in compliance with the provisions of the Information Technology Act, 2000 and the rules and regulations made thereunder, including the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

2. CONSENT TO THIS POLICY AND CHANGES IN POLICY

By downloading and using the Application, the user ("User") expressly gives Xopay consent to collect, store, process, and use the User Information in the manner set forth in this Privacy Policy. If the User does not agree to the terms of this Privacy Policy, please do not use or access the Application.

By accessing the Application or otherwise providing any User Information, each User will be deemed to have read, understood, and agreed to the terms and conditions outlined in the Privacy Policy.

Xopay may modify this Privacy Policy from time to time. Any such modifications will be updated and published on the Application. Users are encouraged to review the Privacy Policy periodically.

3. LINKS TO THIRD PARTY WEBSITES

The Application may contain links to third-party websites (for example, education boards, exam registration portals, or affiliated institutions). Any personal information provided on such third-party websites is not governed by this Privacy Policy. Xopay shall not be responsible for and has no control over such websites.

4. COMPETENCY TO CONTRACT

By agreeing to this Privacy Policy, a User represents that the User is at least 18 years old and competent to contract under Indian laws. In the case of a minor (below 18 years), the Application and Services must be accessed only under the supervision of a parent or legal guardian.

5. INFORMATION COLLECTION

Xopay collects two types of information:

Personal Information (identifies the User)

Examples: name, email address, mobile number, postal address, date of birth, parent/guardian details, institution details, student roll/registration number, payment details (UPI, debit/credit card, net banking, wallet, etc.), and government ID for verification if applicable.

Non-Personal Information (does not directly identify the User but relates to usage patterns)

Examples: device details, browser type, IP address, geolocation, technical usage data, and information about how the Application is accessed.

Additionally, Xopay may collect information about:

  • Transaction Details – amount, payment method, beneficiary institution, and payment status.
  • Device & Access Information – cookies, login details, and activity logs for security and analytics.
  • Educational Information – institution/board details, admission ID, and fee structure for processing payments.

6. INFORMATION NOT TO BE UPLOADED

Users shall not upload or share any unlawful, misleading, obscene, or unauthorized data while using the Application. In particular, Users must not upload any information unrelated to educational payments or data that violates intellectual property rights, privacy rights, or applicable Indian laws.

7. PURPOSE OF COLLECTION AND USAGE OF INFORMATION

Xopay uses User Information solely for purposes related to education payments, including but not limited to:

  • Processing and completing school/college/educational payments.
  • Providing transaction receipts, confirmations, and support.
  • Verifying and authenticating student identity and payment details.
  • Complying with institutional and regulatory requirements.
  • Sending important updates related to fees, due dates, and payment reminders.
  • Preventing fraud, chargebacks, or unauthorized use of the Application.
  • Improving services through analytics and user feedback.

8. STORAGE, SHARING AND SECURITY

  • User Information may be stored on secure servers in India or abroad with third-party data centers.
  • Data is encrypted and safeguarded with reasonable security practices as required under Indian law.
  • Information may be shared with educational institutions, payment gateway providers, acquiring banks, and regulatory bodies as required to process payments.
  • Information may also be disclosed if required under applicable law, by law enforcement, or by court orders.

9. RETENTION OF DATA

User information will be retained only for as long as necessary to fulfill payment-related obligations, resolve disputes, comply with legal requirements, and for audit purposes.

10. COMMUNICATION POLICY

By registering on Xopay.co, Users agree to receive SMS, email, and push notifications related to their transactions, reminders, and important updates. Promotional communication can be opted out of by writing to support@xopay.co

11. USER RIGHTS

Users may request access, correction, or deletion of their personal data by contacting Xopay's Data Protection and Grievance Officer at support@xopay.co. However, Xopay may retain certain information as required under applicable law.

12. TERMINATION OF ACCESS

Xopay reserves the right to terminate or suspend a User's access if they are found violating this Privacy Policy, applicable laws, or engaging in fraudulent or abusive activities.

13. LIMITATION OF LIABILITY

Xopay shall not be liable for any direct, indirect, or incidental damages arising from use of the Application, delays in processing, or unauthorized access beyond its reasonable control.

14. INDEMNITY

Users agree to indemnify Xopay against any claims arising due to misuse of the Application, violation of law, or breach of this Privacy Policy.
